The relationship between European law and the criminal justice system

Educational objectives
The Course will concern the relationship between national criminal law and supranational law (EC/EU Law in criminal matters, European Human Rights Law), and the mutations affecting principles and categories of the domestic criminal justice system; all above, with the aim to promote subsequent access to postgraduate courses, doctoral Schools, and other professional activities (forensic cereers, business consulting).The students will develop a multidisciplinary and praxeological understanding of this field

Teaching methods
The main didactic method will be the “head-on classes"; seminars could be added. Lectures and seminars will be managed by referring to statute- a and case-law

a) Human rights and criminal law (introduction to). The s.c. counter-limits doctrine

PART II - CRIMINAL LAW AND EUROPEAN HUMAN RIGHTS LAW

a) Intro
b) The construction of the basic conceps of criminal law by the ECtHR:
- the concept of criminal law
- the concept of criminal matters
- the concept of criminal punishment
- the impact on the national system
c) the construction of criminal law principles by the ECtHR:
- non retroactivity, void for vagueness, and strict interpretation
- lex mitior
- principle of secularism in criminal law
- the impact on the national system
d) the "European review of the judgment"

PART III - CRIMINAL LAW AND EU LAW

a) The European criminal law (before and) after the Lisbon Treaty
b) European criminal policies:
- scraps of "general part" and "special part"
- a "Manifesto of European criminal policy"
c) The dialogue between ECJ and ECtHR and the rule of law
d) the weakness of the principle of legality in criminal process (Pupino, Melloni and Taricco cases)
