- The course aims to provide an overview of the evolutionary lines and transformations undergone by commercial law between the medieval, modern and contemporary ages, with particular attention to sources (legislative, doctrinal, documentary, jurisdictional), institutions and jurists.

- Educational objectives
- Acquisition by students of a good knowledge of the historical evolution of commercial law and of the importance of considering law, in particular commercial law, also in a historical perspective, perceiving and arguing its changes, processes of rupture and continuities.
- Prerequisites
- To understand the topics covered in the course and achieve the learning objectives, the student must possess basic elements of general culture and essential knowledge of medieval, modern and contemporary history.

- Foreign students participating in the Erasmus project will be able to take the exam by agreeing a special program with the teacher.
For students with DSA, appropriate compensatory tools and specific measures will be agreed individually.

In order to evaluate the student's preparation, the following will be taken into account: 1) the notions acquired about the historical periodization, the evolution and the contents of legal thought and institutions; 2) the ability of critical analysis and reasoning in identifying the essential junctures of the historical path and the contents of the legal institutions studied; 3) the adequacy of the technical-legal language used in the presentation. - Extended program
- The historical category of commercial law: birth and development of the ius mercatorum. Specialty and universality of merchants’ law. Merchants and artisans in municipal society. The universality of the ius mercatorum. The origin of the joint-stock company: the East India Companies. The nationalization of commercial law: the Ordonnance du commerce (1673). The Code de commerce (1807). Commercial legislation in the experience of the pre-unification Italian states. The Italian Commercial Code of 1865 and that of 1882. The unification of the civil and commercial codes (1942). The new lex mercatoria.
