- The interaction between Law and Religion: brief overview. Law and Religion in context. Spaces, models, dynamics throughout history and geopolitics (Introductory remarks). International and regional legal protection of freedom of religion or belief (first module). Law of Religion in Italy. Legal overview and comparison with other European countries (second module). Freedom of religion or belief and human rights: trends and tensions (third module).

- Educational objectives
- Basic knowledge about international and European legal standards of protection of freedom of religion or belief. Basic knowledge of the variety of national legal systems regarding religion in European countries, with particular focus on the Italian system. Understanding of the current debates around freedom of religion or belief and human rights, through discussion of case-law and legal arguments. Developing the ability to set any legal question about religion in the correct legal and historical backdrop, evaluating current trends and controversial issues Developing skills in legal argumentation and finding solutions.
- Prerequisites
- To students currently attending the LM01 curriculum the usual preconditions apply (having successfully passed the exams of Private Law and Constitutional Law).No other mandatory prerequisites are required. In order to actively attend lessons and take part in class discussions, a basic knowledge of history and law would be helpful.
- Teaching methods
- The course will be divided into three internal modules. Each module will take nine lessons. Lessons will be held six hours per week and will be organized as such: lectures on all the relevant topics. PowerPoint presentations in English will be used, in order to facilitate comprehension and note taking on sources and citations. Discussion in class on all the subjects will be favoured. Material will be given in advance (reference of cases, journal articles, newspaper columns) to allow students to take part in collective discussion and solution-finding in controversial cases. At the end of each module, a class will be devoted to review the pertaining topics. More details will be given during the first lesson.

- Learning verification modality
- The aim of the exam is to assess and evaluate candidates’ degree of knowledge, understanding and skills on the subjects indicated under the heading “obiettivi formativi”. For students attending the course on a regular basis, the oral exam will be the discussion of their written brief report focused on a subject among the ones discussed during lessons. For students not attending classes, the oral exam is a discussion on all the relevant topics dealt with in the selected bibliography (see under the heading: “testi di riferimento”). The exam will be conducted through questions and answers and it will last approximately 15-20 minutes (depending on the competence of the candidate). Candidates who are interested in specific topics can contact the professor for further bibliographic references.

- International protection of FoRB (UN system: legal standards, soft-law, case-law, recent trends). Regional protection at the EU level: European Union and religion FoRB before the Strasbourg Court: an analysis of article 9 ECHR and its application in the ECtHR case law. A brief introduction to the Italian history of relations between Church and State. Constitutional provisions on religion law; bilateral and national sources of law. Controversial issues about Islamic communities in Italy. Freedom of religion or belief and human rights (e.g.: freedom of expression; religious symbols; spiritual assistance, new religious movements; autonomy of religions)
