II - MODELS AND SANCTIONING FUNCTIONS OF CRIMINAL LAW (M-Z)

Contents The Module is divided into two parts, the first part, the most relevant one, encompassing the deepening of the legal issues of a general part that are differently linked to the institute of "Pena (Penal sanction)" and provides for the discussion of the following themes:1) Criminal Law History: Statements; The death penalty and torture; The functions of the punishment.2) The main punishments in the Italian criminal system: The life imprisonment and other penitentiary sentences; The pecuniary penalty; The alternative sanctions for short-term imprisonment sentences; The sanctions of corporate liability.3) The problem of punishment (Articles 132 and 133 c.p.); The tenuity of the fact (Article 131bis c.p.); The principle of favor rei; The relevance of the cultural factor (Multiculturalism).4) Special sanctioning models: criminal law "of minors" and Criminal Justice of the Judge of Peace; Criminal mediation.5) Alternative measures of detention, in particular, the probation with the social services and “semilibertà”.The second part, the shortest, most specialized, will be dedicated to the study of some of the criminal figures involved in the crimes against the person.

(a cura di), Questioni fondamentali della parte speciale del diritto penale, Giappichelli, Torino, 2016, limited to Capitoli 1 e 2 della parte I (“I reati contro la persona”).Alternatively, FIANDACA G.-MUSCO E., Diritto penale, parte speciale, Zanichelli, Bologna, ultima edizione, limited to Capitolo 1( “I delitti contro la vita e l’incolumità personale”) e al Capitolo 4, Sezione II (“I delitti contro la libertà morale”).
Educational objectives The module intends to deepen the “PENA” institute from all its points of view, history, functions, classical, "special" and "innovative" types (recently introduced in the court of cognition) , execution and extinction. The discussion of the issues mentioned will always be accompanied by a review of the jurisprudence case, in order to bring the student closer to the dimension in action of criminal law.
