This course is an introduction to the theory and practice of law and
development.
This course is divided into two parts. The first part focuses on
understanding the basic concepts of “law and development”. In this part,
we examine the key actors in development cooperation at the
international, regional, national, and sub-national level. We also look at
the combination of national, international, and ‘soft law’ legal sources,
that characterizes the current development context. The second part of
the course focuses on project cycle design and management (PCM):
students will understand how a ‘typical’ EU technical assistance project

Altre informazioni La partecipazione significativa in classe è fortemente incoraggiata. Gli
studenti sono invitati a leggere in anticipo gli argomenti discussi nella
lezione successiva in modo da poter poi partecipare attivamente alla
discussione in aula. La docente sara’ disponibile al termine di ogni lezione
per rispondere ad eventuali domande e dubbi. Gli studenti potranno
inoltre raggiungerla via e-mail o cellulare per fissare un appuntamento.

Il voto finale sara' cosi' costituito: 60% esame orale; 40% qualita' dei
documenti progettuali predisposti individualmente dallo studente e
discussi in classe
Programma esteso ll corso analizza il ruolo svolto dai principali attori della cooperazione
internazionale nello sviluppo giuridico dei diversi paesi. Esso consentira’ a
studenti non giuristi di acquisire familiarita’ con concetti e materiali
giuridici, e di approfondire i paradigmi e i temi fondamentali nell’ambito
dello sviluppo.
Nella prima parte del corso saranno discussi i seguenti argomenti:
- Origine e significato del concetto di "assistenza allo sviluppo" e i suoi
indicatori.
- I beneficiari dell'aiuto: stati fragili, paesi meno sviluppati, economie
emergenti
- I principali attori dello sviluppo: a) il sistema delle Nazioni Unite, le
organizzazioni e le agenzie specializzate; b) le istituzioni finanziarie
internazionali (FMI e BM); c) l'UE ed il Servizio Europeo per l’Azione
Esterna (SEAE), gli strumenti, i programmi e loro attuazione, il
coordinamento tra gli stati membri, la programmazione congiunta e
quella delegata; d) l’OSCE, il DAC e il gruppo di lavoro sull'efficacia degli
aiuti; e) gli attori statali: la cooperazione allo sviluppo italiana e la recenti
riforme; f) una panoramica sulle ONG (internazionali e nazionali).
La seconda fase del corso e’ incentrata sugli strumenti per la
formulazione e l'attuazione dei progetti dell'UE. Gli studenti impareranno
cosa significa ‘gestione del ciclo del progetto’ (PCM) e ad orientarsi nelle
sue diverse fasi. Ciascuno studente svilupperà due documenti progettuali
chiave (il quadro logico e il piano d'azione) relativamente ad un progetto
specifico e con il supporto attivo del docente. Da ultimo, gli studenti
discuteranno la versione finale dei loro elaborati in aula di fronte ai
colleghi di corso.

The first part of the course is based on frontal lecturing, with the support
of audio-visual materials. Students are encouraged to read in advance
the teaching materials, to be able to engage in active discussion in class.
The second part of the course is based on coaching. Students will develop
the core documents of the project cycle (logframe and action plan) by
themselves with the active support of their teacher. Through a series of
successive refinements (iterative method), students will prepare a final
draft of their documents and will discuss it with their classmates.

Educational objectives
This course has three goals. First, it seeks to provide students with an
understanding of what ‘Law and Development’ means, and how to
measure it. Second, it offers an overview of the major actors active in the
development field at the global, regional, and national levels, and of their
diverse operational schemes and practices. Third, it aims at teaching the
practical basic tools for project design and management, with special
regard to the EU context.

Meaningful classroom participation is strongly encouraged. Please do the
reading and be prepared to participate in the classroom discussions. I will

This course focuses on the role played by the main international
development agencies in the legal development of various countries.
Non-lawyers will familiarize with legal concepts and materials, as well as
with the key concepts of legal development.
The first part of the course will address the following topics:
- The origin and meaning of “development assistance” and its different
indicators.
- The aid receivers: fragile states, least developed countries, emerging
economies
- The main development actors: a) the UN system, organizations and
specialized agencies; b) the international financial institutions (IMF e WB);
c) the EU and the EEAS, instruments, programmes and their
implementation, the coordination between member states, joint and
decentralized programming; d) OSCE, DAC and the Working Party on Aid
effectiveness; e) state actors: the Italian development cooperation and its
reform; f) overview on the NGOs (international and national).
The second part of the course will focus on the tools for the formulation
and implementation of EU development projects. Students will learn what
Project cycle management (PCM) is and how to navigate its different
phases. Each student will develop two core project documents (logframe
and action plan) for a specific project with the active support of their
teacher. Students will then present the final version of their logframes
and action plans in class to their peers.
