- The course aims to study the casuistic method of Roman jurisprudence, to develop the ability to grasp the argumentative paths used in the elaboration of legal solutions and to critically examine legal texts.
- Prerequisites
- The course requires the institutional knowledge of Roman public and private law.
The exam of 'Storia e istituzioni di diritto romano' is preparatory. - Teaching methods
- Front lecturing; flipped lessons; use of the Unistudium platform.

- The exam consists of an oral test aimed at verifying the knowledge and understanding of the topics that are the subject of the course, as well as evaluating the ability to exhibit and reasoning. In particular, the student must demonstrate that he is able to interpret a legal text and to identify the rationale of the jurisprudential solution. The duration depends on the progress of the test. Works carried out during the course frequency will contribute to the overall evaluation.
- Extended program
- The Justinian's Digest has given the jurist of all time a huge gym to exercise legal reasoning skills. Through the analysis of the sources will be identified techniques and logic used by Roman lawyers. In particular, texts will be examined in which the utilitas is explicitly referred to as the justification criterion for overcoming the issues of ius controversum notwithstanding pre-existing general rules.
