- L'insegnamento mira ad offrire agli studenti, in primo luogo, le indispensabili informazioni 'tecniche' di dettaglio su stili dottrinali, regole operative, argomentazioni e schemi concettuali nelle principali esperienze delle tradizione giuridica occidentale e non; in secondo luogo mira ad offrire una visione della natura transnazionale e dinamica della maggior parte dei discorsi giuridici.

- Il corso si propone, in base alle più recenti acquisizioni metodologiche dell'analisi comparatistica, di sviluppare:
- la capacità di orientarsi in sistemi multilivello, caratterizzati cioè dal pluralismo di ordinamenti, regole ed interpretazioni;
- la conoscenza critica delle varie tassonomie del diritto privato allo scopo di valutare la loro relatività storica e gli obiettivi ai quali si è pervenuti in altri sistemi con il loro uso;
- il modo in cui somiglianze e differenze sono state delineate e quali possono essere le strategie ed i progetti ideologici di tali discorsi giuridici. - Teaching methods

- The final exam consists of an oral examination in order to assess, together with their knowledge of the legal data, the logical-legal ability and appropriateness of the legal language. The duration of the examination varies according to the performance of the query.
- Extended program
- In contemporary comparative law analysis, there has been an increasing emphasis on legal traditions which replaced a previous approach in terms of legal families and legal systems. Tradition plays a crucial role, marking a boundary in a much stronger way than mere difference when we compare and contrast systems. As such the notion of tradition is the basis for a set of different arguments when we set out to discuss, reform or harmonize different systems. The course will show how a tradition can work in the actual process of integration to limit or resist harmonization, to slow down its process or to minimize its impact.
