The five stages of constitutionalism in the Arab countries and the current trends of constitutional law in the Arab world. Islam and positive law: islamic law and the law of Islamic countries. The sources of Islamic law: basic notions.

Learning the basic notions regarding the sources of Islamic law and the evolution of constitutionalism in the Arab and Islamic world, in order to understand the current political and constitutional dynamics.

Introduction to Constitutionalism in the Arab-Islamic World: relationship between the autochthonous legal tradition and European constitutional systems; the Ummah and the State: a comparison; traditional Islamic institutions: Caliphate and Sultanate; the rise of nation states in the Arab world; the four stages of Aarab constitutionalism; the recognition of Islam as a source of law; Islam and positive law: the role of judges; current trends of constitutional law in Arab countries. ¿The Sources of Islamic Law: the notion of shari'ah, fiqh and usul al - fiqh; the four schools of law; the usul al - fiqh in al - Shafi'I's Risala; the characters of fiqh; the role of ijtihad in the organization of fiqh; the Koran; the Sunnah of the Prophet; the ijma; the qiyas; subsidiary sources of law; customs.
