General Principles in Criminal Law.The Purposes of Punishment. Purpose of general deterrence. Purpose of retribution, principles of fault end of proportionality. Purpose of specific deterrence. Purposes of rehabilitation and retribution. Principles oh humanity. Administrative sanctions. Corporate liability. Actus rea. The criminal law protection: crimes of danger and of harm. Actus reus. Principles of legality.
The mental or moral element of the offense (mens rea).The material or physical element of the offense (actus rea). The causes of justification and excuse. Criminal attempt and the partecipation of a criminal offence.
Circumstantial crime. Partecipations in crime: plurality of person. Criminal attempt. Unity or plurality of crimes.

- The Course will provide to students the basic concepts of "European Criminal Law", through a constitutionally oriented and practical approach.
The critic-dialogic method will help students to understand the rationales of the Rule of Law in Criminal Justice and other Principles (eg mens rea, harm-principle) involved by the selected offences.
The objective is to implement a technical, axiological and practical approach to Criminal Law - Prerequisites

- The main didactic method will be the “head-on classes"; seminars could be added. Lectures and seminars will be managed by referring to statute- a and case-law

- The Course will concern the relationship between Criminal Law and European Law (EU Law in Criminal Matters, European Human Rights Law), with special regard to the s.c. duty of consistent interpretation, and the domestic legal instruments to implement the Supranational Law and Case-Law.
With regard to the Special Part, it will be selected significant offences against the life and the personal integrity (eg murder and euthanasia), the personal liberty (eg slavery, child pornography, error aetatis), the sexual liberty (eg sexual violence), the moral liberty (eg threat, stalking), the crimes against reputation, and the offences against the Public Administration (artt. 317, 318 e ss., 319-quater, 346-bis C.C.) and against financial interests (artt. 316-bis, 316-ter C.C.) in the light of recent reforms

- The Module II will address the study and deepening of some basic offenses of the special part of the criminal law: crimes against the life and personal safety, crimes against property, crimes against public order, crimes against the personality of the State and public agents crimes against the public administration.

- Educational objectives
- The Module II aims to provide a good knowledge of the more important crimes of the special part of criminal law, as well as to develop student's ability to enhance and critically analyze the discipline.
Basic knwoledge students will be able to gain will be:
- Knowledge of the relations between the general part and the special part of criminal law
- Knowledge of the discipline of the most important offenses of the special part of criminal law.
The main skills that allow students to apply the knowledge acquired will be:
- ability to understand legal texts and case law;
- critical thinking and evaluation autonomy in the analysis of controversial exegetic issues;
- ability to expose the knwoledge acquired, using appropriate technical language. - Prerequisites
- The student must have knowledge that derive him from having claimed the other exams in the years preceding the year in which he intends to take the examination of criminal law. Such knowledge are deemed useful in order to acquire a good command of legal language.

Laboratory activities that actively involve the student in studying the legal issues posed. - Other information
- The Module II is part of the Criminal Law Teaching (M-Z), which is therefore referred to the Prerequisite Guidelines and Learning Modes test.
- Learning verification modality
- The test consists of an oral examination. The questions focus on the program as described by the teacher on the related tab. For the purposes of evaluation the subject knowledge, the reasoning ability, the logic of the argumentation and the learning of their teaching methodology will be emphasized. The duration of the test varies according to the trend of the same.
