- The education of the jurist requires the acquisition of knowledge that allow to evaluate the legal facts with a "philosophical" approach, through the identification of the movements of thought that have determined and characterized the legal systems of the European area (common law - codified systems).

- The aim of the course is the study of the nature and character of the legal systems founded from the V century on by examining the various sources, thus introducing the student to the complexity of the contemporary legal world, legal systems and current laws not only from a national, but also a european perspective.

- The course is made up of tree parts. The first part consists of the sources of law in the medieval and modern periods and students will study the systems that became established in the Italian peninsula following the breakdown of Roman institutional unity and the new age heralded by the revival of of learning and the teaching of Roman law in the Bologna school. Particular attention will be given to the development of communal law, the interaction between the two universal legal systems (civil and canon law) and their relationship with the laws in force in the different systems. The historical develoment of communal law will be followed until its crisis, signalled by the beginning of codification, the new expression of nations. The second part of the course will analyse the influence of natural law and illuminism on the new legislation and the reasons and structures of the Napoleonic codes and other 18th century codifications with particular attention to Italian regional codifications and Italian legislative unification.
The last part of the course will analyse and consider the influences and the persistence of the legal tradition in the current structure of the civil law and common law, through practical evidence.
