Educational objectives
The analysis of the forms of criminal justice will enable the student to understand the values and principles underlying the procedural model adopted, the nature of evidence, the power attributed to the judge, the guarantees granted or denied to the defendant, and the system of penalties.

Learning verification modality
Oral exam, during which the student will be required to show that he/she knows and understands the major issues addressed during the lessons. The following evaluation criteria will be taken into account to assign the final grade, expressed in thirtieths: - knowledge and understanding of the historical and doctrinal sources (60%); appropriate use of the technical and legal vocabulary, ability to analyse and evaluate relevant sources and acquisition of the study method (20%); ability to orientate oneself in the diachronic context and to identify the historical perspective of the legal phenomenon (20%). Learning gaps concerning one or more notions or principles will lead to an insufficient evaluation, even in presence of a basic knowledge of the matter

1) The forms of criminal justice in the Early Barbarian Middle Ages. 2) The evolution of the forms of criminal justice in the italian cities of late medieval age and the normative foundations of the per inquisitionem procedure. 3) The penal repression of heresy. 4) Practices and doctrines of judicial torture. 5) The inquisitorial procedure in the age of the Counter-Reformation. 6) The Enlightenment critique and the legislation of 18th century absolutism; Cesare Beccaria. 7) Criminal law and criminal trial after the French Revolution. 8) Codification of criminal law and criminal trial in Europe in the 19th century. 9) Criminal justice during fascism.
