Contents Legal Clinic I aims to provide students with theoretical and practical training in the field of private law, as well with civil procedural law. Cases examination can reasonably import the acquisition and/or improvement of knowledge also pertaining to other disciplinary fields (e.g. public law).
Reference texts In the examination of each case study, bibliographical and jurisprudential material, specifically selected for its reconstruction will be supplied to the Students. They will be required to hone their aptitudes for autonomous research, through access to databases and library, during the resolution of legal issues proposed.
Educational objectives Legal Clinic I aims to provide legal training through the experience of working on concrete, real and/or possibly even simulated cases (but inspired by real events), adapted to the specific objectives of the teaching. From structural point of view, the course will be divided into three phases: theoretical, practical, and verification/simulation.
Prerequisites Adequate knowledge of the fundamental institutes of private law. Knowledge of the main institutions of civil procedural law is also highly recommended.
Teaching methods Clinical and case studies method, applied to the resolution of practical cases (learning by doing). For this, we strongly recommend attendance in the presence of the course. Students will be able to complete the theoretical teaching, also practicing it in a real context.
Other information From the 2nd to the 5th year; recommended attendance specifically to those who have already taken the examination of civil procedural law, because of the strict connections with issues and procedural institutions.
For students with disabilities and/or DSA, please follow the guidelines of the University contained in the following link https://www.unipg.it/disab-e-dsa/studenti-con-dsa#strumenti.
Learning verification modality Oral interview on the cases addressed, aimed at verifying not only the assimilation of the theoretical knowledge transmitted, but also and above all the acquisition of practical skills exercised and developed through the course activities.
Extended program The lessons will be divided into three phases: theoretical, practical, and verification/simulation.
The first one will be a lesson aimed at providing students with the essential and indispensable theoretical tools to deal with the selected case. It will also give space to moments of direct confrontation with the subjects involved, in various ways, in the legal case treated.
The second phase will be aimed at providing professional training to students, called to continue the work on the case study presented, through the activity of discussion and practical solution in the real/simulated context. The activities of study, discussion and writing, will adapt to the modus operandi typical of those of counselling and advocacy, typical of the forensic professions.
The third and final phase of work on the case will be dedicated to the concrete deployment of the knowledge and techniques learned, through the simulation of a hearing, in which the students will interpret the opposing parties of the process.
